Elmfield Road v Trillium

Judgment was handed down this morning by the Court of Appeal in Elmfield Road Ltd v Trillium (Prime) Property GP Ltd.  The Court (Lewison and Leggatt LJJ) dismissed the appeal, in which the Appellant sought to contend that a rent review indexation clause in a lease contained an ambiguity or an obvious mistake, which ought to be cured by amendment to the drafting.  Guy Fetherstonhaugh QC acted for the successful Respondent.
