Court of Appeal decision on shellfishery orders

The Court of Appeal has given judgment in this case, confirming that a savings clause in a shellfishery order did not give the appellant landowners the right to develop a marina on the foreshore and seabed within the bounds of the fishery. The judgment has important ramifications for fisheries orders around the coast of England and Wales that are subject to similar savings clauses. Guy Fetherstonhaugh QC acted for the shellfishermen
