In his latest article for Estates Gazette, Money for nothing, Guy Fetherstonhaugh KC discusses the decision in Into Nominee One Ltd v Study Group UK Ltd (TCC) on whether fire safety defects discovered at premises used as a residential educational establishment frustrated the common purpose of the lease. Guy and Elizabeth Fitzgerald, instructed by BCLP, acted for the claimant in the case, succeeding with a summary judgment application. Guy’s article considers the significance of the lease containing provisions regarding potential defects and allocation of risk, and asks whether conditions of fitness for habitation should be implied into new tenancies.
