In his latest article for Estates Gazette, Money for nothing, Guy Fetherstonhaugh KC discusses the decision in Into Nominee One Ltd v Study Group UK Ltd (TCC) on whether fire safety defects discovered at premises used as a residential educational establishment frustrated the common purpose of the lease. Guy and Elizabeth Fitzgerald, instructed by BCLP, acted for the claimant in the case, succeeding with a summary judgment application.
