Kester Lees KC acts for EDF in dismissing summary judgment application in relation to major national infrastructure project
Kester Lees KC, leading Richard Clegg, acted for EDF in Acland-Hood v EDF & Anr , and successfully resisted the landowner’s summary judgment application.
The High Court claim concerns the interpretation of contractual obligations as to restoration and seeding. The landowner sought summary judgment following issue by way of Part 8. Joanna Smith J. dismissed that application, awarding (partial) indemnity costs, and agreeing with EDF that the claim ought to be transferred to Part 7 and re-pleaded from scratch.
