Kester Lees KC successfully acts for Hawridge in High Court summary judgment application
Kester Lees KC, leading Charles King of Maitland Chambers, was brought into the case to defend a summary judgment application in the High Court in a multi-million pound dispute concerning option agreements and development agreements.
In Hawridge Strategic Land Limited v Millen Homes Limited, three issues arose before Master Clark: (i) whether there was a contractual duty, (ii) assignably, and (iii) whether a duty of care arose.
Whilst the Master Clark determined that, as a matter of construction, there was no contractual duty, Hawridge was successful on the assignability and duty of care issues. Therefore, the remainder of the claim survived the summary judgment application.
