Regent Wealth v Wiggins [2019] UKUT 0310 (LC)

On 17 October 2019, Judge Cooke in the Upper Tribunal handed down judgment in Regent Wealth v Wiggins [2019] UKUT 0310 (LC).

Jonathan Gaunt QC and Anthony Radevsky acted for the appellants and Stephen Jourdan QC, leading Tom Jefferies, acted for the first respondent.

The decision concerned the interpretation of a covenant against alienation in three licences to underlet flats in Mayfair, granted in unusual circumstances. The judgment includes a review of the circumstances in which it is possible to correct a mistake in the drafting of a document as part of the process of interpreting the document, and the law on implied terms.
