The Church Commissioners for England v Etablissment Enterprises Dupont (First-tier Tribunal, Property Chamber, 14 February 2020)

Anthony Radevsky (instructed by Alison Usher of Radcliffes Le Brasseur) acted for the Church Commissioners in this valuation dispute under the Leasehold Reform Act 1967.  It concerns a substantial house in London’s Little Venice, 25 Blomfield Road, overlooking the Regent’s Canal. The Tribunal determined the enfranchisement price to be £9,373,968, a high figure partly because the claim was made only 3 days before the lease was due to expire. Vanda Kelsey of Knight Frank, the landlord’s expert, contended that the price should £9,590,400, whereas the tenant’s valuer said that it should be £7,665,978.
