In an article for the Woodfall Landlord and Tenant Bulletin, Nat Duckworth KC considers whether an option in a lease is an agreement for a future tenancy within the meaning of s.28 of the Landlord and Tenant Act 1954 at its inception - an issue which the Court of Appeal will shortly consider in Park Cakes Limited v Caterpillar Property Limited - and whether, if not initially, it might become a s.28 agreement when the option is later exercised.
