The Upper Tribunal handed down judgment in Simon Nelson v Southern Electric Power Distribution [2025] UKUT 0213 (LC) on 1st July 2025, its first electricity compensation decision under paragraph 7 of schedule 4 to the Electricity Act 1989 in 12 years.
The Tribunal valued the loss to the claimant of a more valuable development by reason of the imposition of a necessary wayleave in 2023 over existing assets.
